Terms of Service

Rules for using Kitsap Adventures, creating accounts, submitting listings, and relying on directory or adventure information.

Effective and last updated: August 30, 2026. These Terms of Service (“Terms”) govern access to and use of kitsapadventures.com and the Kitsap Adventures directory, account, submission, and editorial services (collectively, the “Service”). The Service is operated by Aldermedia under the Kitsap Adventures name (“Kitsap Adventures,” “we,” “us,” or “our”).

Please read these Terms carefully. By using the Service, creating an account, or submitting content, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service provides

Kitsap Adventures is an independent directory and editorial publication intended to help people discover parks, trails, shore access, recreation facilities, local operators, tours, classes, games, and other experiences in and around the Kitsap Peninsula. The Service may include editorial listings, user-submitted listings, town and topic pages, articles, search tools, contributor profiles, and links to official or third-party sources.

Kitsap Adventures is not the owner, operator, booking agent, emergency service, regulator, guide, insurer, or safety authority for the places and activities it describes unless we expressly say otherwise.

2. Eligibility and accounts

You must be at least 13 years old to create an account or submit personal information. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms. The Service is not directed to children under 13.

You agree to provide accurate account information, keep it current, use a strong and unique password, and protect your credentials. You are responsible for activity under your account unless applicable law says otherwise. Notify us promptly at gpt@aldermedia.net if you suspect unauthorized access. You may not impersonate another person or organization, create an account for someone without authority, or transfer an account to evade enforcement.

3. Adventure, travel, and safety notice

Outdoor recreation, water access, travel, physical activity, classes, tours, equipment use, and local experiences can involve inherent and changing risks, including weather, tides, currents, terrain, wildlife, traffic, transportation interruptions, closures, fire, falling objects, equipment failure, physical exertion, illness, injury, property loss, and actions of other people. Conditions can change after a page is checked or published.

You are responsible for deciding whether an activity is appropriate for you and your group; checking current alerts, laws, permits, access, hours, fees, reservations, ferry and transit schedules, weather, tides, skill and age requirements, accessibility, insurance, equipment, and operator credentials; following official instructions; and using qualified professional guidance when appropriate. Never rely on the Service as your only source for safety, navigation, emergency, medical, legal, or weather decisions.

Call 911 or the appropriate local emergency service in an emergency. The Service does not monitor conditions continuously and cannot provide emergency assistance.

4. Accuracy, changing conditions, and no endorsement

We aim to use official, agency-controlled, organizer-controlled, operator-controlled, or otherwise authoritative sources, but we do not guarantee that every listing, source, link, alert, price, schedule, rule, address, coordinate, image, review date, or description is complete, current, or error-free. A source-check date means a source was reviewed; it is not a promise that conditions remain unchanged.

Inclusion, placement, a link, or editorial coverage is not an endorsement, certification, inspection, recommendation for every user, or guarantee of quality, safety, legality, availability, or fitness. Listed organizations and agencies do not necessarily sponsor, approve, or control Kitsap Adventures. Our Editorial, Linking & Advertising Policy explains our source and commercial-disclosure standards.

5. Submissions and public listings

Registered users may suggest or submit content for editorial review. A submission does not guarantee publication, timing, placement, permanence, a favorable description, a link, search visibility, or any commercial benefit. We may verify, edit, format, combine, label, reject, unpublish, or remove content in our editorial discretion, subject to applicable law.

Your promises about submitted content

When you submit text, facts, contact details, locations, images, video links, source material, or other content (“User Content”), you represent and warrant that:

  • the submission is accurate to the best of your knowledge and not materially misleading;
  • you have authority to submit it and grant the license below;
  • it does not infringe copyright, trademark, privacy, publicity, confidentiality, contract, or other rights;
  • you have obtained necessary permissions and releases, including for identifiable people and private property shown in media;
  • it does not contain malware, hidden tracking, spam, unlawful material, or manipulative links;
  • it does not expose a person’s private address, precise personal location, credentials, identification numbers, health information, or other sensitive data without a valid, lawful reason and authorization; and
  • it complies with these Terms and applicable law.

Do not upload an image of a child unless you are the parent or legal guardian or have documented authority from one, and publication is lawful and appropriate.

License to User Content

You retain any ownership you have in User Content. You grant Kitsap Adventures a nonexclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, edit, adapt, format, translate, publish, display, distribute, link to, and promote the User Content as reasonably necessary to operate, secure, improve, and publicize the Service and its listings. This license continues while the content is published and for a reasonable period in backups, revision history, legal records, and materials already created. We will consider valid removal requests, but removal may be limited by law, editorial rights, public-record status, third-party copies, or reasonable archival and security needs.

Give us only rights you are authorized to grant. You are responsible for compensation or obligations owed to photographers, writers, licensors, performers, or other rights holders.

6. Listing claims, corrections, and editorial control

A business, operator, property owner, submitter, or account holder may provide useful information but does not purchase or obtain control over verified facts, safety context, source disclosures, corrections, or editorial conclusions. We may preserve a factual record even when a submitter asks for promotional language or removal. We may also remove personal information or content when privacy, safety, accuracy, law, or public-interest considerations support removal.

To request a factual change, use Corrections & Listing Updates and identify the exact page, disputed field, proposed correction, and a current authoritative source. A request does not guarantee the requested result.

7. Prohibited conduct

You may not use the Service to:

  • violate law, regulation, court order, permit, or another person’s rights;
  • submit false, deceptive, fraudulent, defamatory, threatening, harassing, hateful, obscene, exploitative, or unsafe material;
  • impersonate a person, business, agency, owner, or operator or falsely claim authority;
  • publish private, confidential, sensitive, or doxxing information without lawful authority;
  • upload malware, interfere with the Service, probe security, bypass access controls, misuse forms, or attempt unauthorized access;
  • send spam, generate fake accounts or engagement, manipulate rankings, create doorway content, sell undisclosed links, or use the Service for deceptive search practices;
  • scrape, harvest, or automatically collect accounts, contact information, or substantial parts of the Service in a way that burdens the Service, violates privacy, or circumvents technical limits;
  • use content or data from the Service to build a competing database where that use infringes our or another party’s rights; or
  • encourage or help anyone do any of the above.

Ordinary search-engine indexing, accessibility tools, and reasonable noncommercial linking are permitted when they respect technical controls and applicable law.

8. Our content and intellectual property

The Service’s original design, branding, software, selection, organization, and editorial content are owned by Kitsap Adventures or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, nonexclusive, nontransferable right to access and use the Service for lawful personal or internal business purposes. No ownership rights are transferred.

You may link to public pages and quote brief portions for commentary or reference where permitted by law and with appropriate attribution. You may not copy the Service wholesale, remove notices, imply sponsorship, or use our marks in a way likely to cause confusion without written permission.

If you send suggestions or feedback that are not confidential, you allow us to use them without restriction or compensation.

9. Copyright and rights complaints

If you believe content on the Service infringes your copyright or another legal right, email gpt@aldermedia.net with the subject “Kitsap Adventures Rights Complaint.” Include your contact information, the exact URL and material at issue, the basis for your claim, evidence of your rights or authority, and the action requested. For copyright claims, identify the copyrighted work and provide a good-faith statement that the disputed use is not authorized. We may request additional verification, forward a complaint to the submitter where lawful, remove or restrict content, or decline unsupported requests.

10. Third-party sites, operators, and transactions

The Service may link to government agencies, parks, operators, booking tools, maps, social or video platforms, and other third parties. Third parties control their own content, availability, security, privacy, prices, transactions, refunds, waivers, accessibility, and terms. A link does not make us a party to your relationship or transaction with them. Review the third party’s current information and agreements directly.

Kitsap Adventures does not currently process public listing payments, reservations, or paid placements. If we add a paid product later, additional checkout, refund, sponsorship, and payment-provider terms may apply and will be presented before purchase.

11. Suspension, moderation, and termination

We may investigate suspected violations and may limit, suspend, or terminate access; reject, edit, or remove content; preserve evidence; or notify appropriate parties when reasonably necessary to protect the Service, users, the public, or legal rights. We may act without advance notice when delay could increase risk, when required by law, or when an account is used for spam, fraud, security abuse, impersonation, or repeated violations.

You may stop using the Service at any time and may request account closure as described in the Privacy Policy. Sections that by their nature should survive termination—including licenses for existing copies, intellectual property, disclaimers, limitations, indemnity, dispute terms, and legal-compliance obligations—will survive.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Kitsap Adventures and its operators, contributors, licensors, and service providers disclaim all warranties, express or implied, including warranties of accuracy, completeness, currentness, availability, merchantability, fitness for a particular purpose, title, noninfringement, safety, and results.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; that any listing, link, route, operator, activity, event, or facility will be available or suitable; or that using the Service will prevent injury, loss, delay, or other harm. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Kitsap Adventures, Aldermedia, and their owners, personnel, contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, goodwill, or opportunity; personal injury or property damage arising from a third-party activity or condition; or damages arising from reliance on directory or editorial information, even if advised that such harm is possible.

To the fullest extent permitted by law, the aggregate liability of those parties for all claims arising from or related to the Service or these Terms will not exceed the greater of the amount you paid directly to Kitsap Adventures for the Service during the 12 months before the event giving rise to the claim or US $100. These limits do not exclude liability that cannot legally be limited, and your jurisdiction may provide additional rights.

14. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Kitsap Adventures, Aldermedia, and their owners, personnel, contributors, licensors, and service providers from claims, damages, losses, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your User Content, your violation of these Terms or law, your infringement of another person’s rights, or your misuse of the Service. This obligation does not apply to the extent a claim results from our own unlawful conduct and may be limited where applicable law does not permit it.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except to the extent federal law or the mandatory law of your residence applies. Any court action that is not required by law to be brought elsewhere will be brought in a state or federal court with jurisdiction in or over Kitsap County, Washington, and you and we consent to that venue and personal jurisdiction.

Before filing a claim, please send a written description to gpt@aldermedia.net and allow 30 days for an informal attempt to resolve it. This informal step does not shorten any legal deadline or prevent urgent injunctive relief.

16. Changes to the Service or these Terms

We may change features, suspend or discontinue parts of the Service, or update these Terms. We will post updated Terms here and change the effective date. If a change materially affects registered users’ rights or obligations, we will provide additional notice when reasonably practical or required by law. Changes apply prospectively from their stated effective date. If you do not agree to updated Terms, stop using the Service and close your account.

17. General provisions

These Terms, the Privacy Policy, and policies expressly incorporated here are the entire agreement between you and us about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with an organizational change or transfer of the Service. Headings are for convenience only.
